2. CHANGES TO TERMS
Cochran Coding Academy reserves the right to, at its sole discretion, modify these Terms without any prior notice to the Users for security, corporate, safety, or any other reason at the sole discretion of Cochran Coding Academy. These Users will be immediately bound to the new and modified Terms and any penalties associated with violating the Terms.
3. USER INFORMATION
With the exception of any use of Personal Information by Cochran Coding Academy outlined in the Privacy Policy, the User is expected to maintain the possession and security of any email, phone number, credit card information, identification, address, legal name, or other information deemed as Personal Information at Cochran Coding Academy's discretion. The possession and security of the same information of any dependents of the User participating or engaging with the Services, known as Participants, is also the responsibility of the User. Cochran Coding Academy is not liable for any lost, forgotten, stolen, or leaked Personal Information, even if such Personal Information was lost, forgotten, stolen, or leaked using or as a result of using the Services.
4. USER CONDUCT
While using the Services, Users are expected to not degrade the use of the Services for any other User or to use the Services for any reason deemed unlawful. The following actions will result in the suspension or termination of a User's ability to access or use the Services without any form of financial compensation.

-
Using the Services for anything deemed unlawful
-
Disrupting the normal operation of the Services, which includes, but is not limited to, interrupting sessions for other Users, harassing any provider of the Services, hijacking any domain names or system accounts used by the Services, and launching a denial of service (DoS) attack on the Services.
-
Booking more than 4 sessions for a week
-
Booking a session to talk about something unrelated to the general topic of the associated private class (i.e. Minecraft, Roblox)
5. CLASS CONTENT
The content of Classes is given as-is. The User may not record video or audio, transcript, or otherwise log the content of the Private Classes nor may the User distribute such recordings, transcripts, or logs.
6. PAYMENT AND REFUNDS
Payment for any products offered by the Services must be paid through one of the methods listed in the checkout screen. Other forms of payment will not be accepted.
A refund can be requested if (a) the class is more than 24 hours away from when the request was issued, and (b) the User has provided their real, valid email address to Cochran Coding Academy via the booking form.
For Package Deals, a cash refund can be issued within 14 days of the Package Deal being purchased.

Alternatively, a User can be given back a booking credit on their Package Deal if they cancel at least 24 hours in advance of a class. The User can do this regardless of how long ago they bought the Package Deal.
In the event of a sickness, injury, technology issue, or family emergency, a cash refund or an extra booking credit can be requested less than 24 hours in advance of a class given the other terms in the Refund Policy are still followed. Refunds of any kind are not issued for the loss of class bookings or Package Deals as a result of violating these Terms.
7. INTELLECTUAL PROPERTY
In the following section, Products describe any work created by the User or Participants through using the Services, Content is the spoken words and visual presentation from the instructor during private classes, and Creator is the User or Participant who created the Product.

When taking a class, the Instructor presents Content with the intent of teaching the Creator how to make Products. The Products made, either with or without Content from the Instructor, are the intellectual property of the Creator. The Content is the intellectual property of Cochran Coding Academy, and the Creator, User, or Participant may not record, save, or distribute the Content. When creating Products, either with or without Content from the Instructor, you are granting Cochran Coding Academy an irrevocable, non-transferrable license to use the Products for any marketing, recruitment, or analysis purposes. Cochran Coding Academy may not use the Products for any purpose not defined in this section without explicit consent from Creator. Likewise, Creator, User, or Participant may not use the Content for any purpose not allowed by the Fair Use doctrine without explicit consent from Cochran Coding Academy. The Cochran Coding Academy name and logo are unregistered trademarks in the United States and internationally. The content of the Site, including marketing images not produced from a Product and any text descriptions on the Site, are owned by Cochran Coding Academy and protected accordingly by copyright law.
8. DISCLAIMERS AND LIMITATION OF LIABILITY
The Content will be taught to the best of the Instructor's knowledge, both of the subject matter and of the Participant's needs. Cochran Coding Academy cannot guarantee any results or timeline for the Participant's learning. The User withdraws the right to pursue legal action against Cochran Coding Academy for the perceived quality of the Content or for the teaching of the Participant. If an issue comes up that warrants formal legal action, the issue should first informally be brought up via email, text, or phone so that Cochran Coding Academy can address the situation or give compensation if necessary. The User can only pursue legal action against Cochran Coding Academy if Cochran Coding Academy fails to find a fair solution through informal communication. The User cannot pursue legal action against Cochran Coding Academy over any rights they've withdrawn as stated in these Terms and the Privacy Policy.
9. TERMINATION
Under any violation of these terms, the User may have their right to use the Services terminated. This will forbid the User from booking any classes or purchasing Package Deals, and it will also void any class bookings or Package Deals previously associated with the User. Upon the termination of a User's use of the Services, any classes booked after the termination or any unused Package Deals will not be refunded or compensated to the User in any way.
10. DISPUTE RESOLUTION
In the event the User desires to file a dispute to their bank against a charge made by Cochran Coding Academy, it is requested that the User first explain their desire for a refund to Cochran Coding Academy via email or phone and why they should get it if they aren't eligible for one according to the Refund Policy. With rare exceptions, a refund will almost always be issued if the User has an unresolved dispute with Cochran Coding Academy. Repeated disputes against charges made by Cochran Coding Academy are grounds for termination of a User's right to use the Services. If Cochran Coding Academy is requested to pay a chargeback to the User, the User's right to use the Services will be terminated after the dispute causing the chargeback has been closed.
11. CONTACT METHODS
If the User has any questions about these Terms, they may contact Cochran Coding Academy via email at support@cochrancoding.com or via text or call at +1(520) 965-4749. Text and data rates may apply.
